Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Thingys (“Thingys”, “we”, “our”, or “us”), operated by Anouk Solutions (Pty) Ltd. By creating an account or using the Thingys app or this website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use Thingys.

2. Description of Service

Thingys is a personal management app for to-dos, income and expenses, jobs, appointments and a calendar. It is a tool for keeping your own notes and records. It is not accounting, tax, legal or financial advice, and you are responsible for the accuracy of what you enter and for any decisions you make from it.

3. Eligibility

You must be at least 13 years old, or the minimum age in your country for using online services if higher, to use Thingys.

4. Account Registration

• You can sign up with a username and password, or with your Google or Apple account.
• Keep your sign-in details safe. You are responsible for what happens under your account, so tell us promptly at support@anouksolutions.com if you think someone else has access.
• Give us accurate information and keep to one account per person.

5. Your Information

What you add to Thingys remains yours. You give us permission to store and process it only so we can run the app for you. How we handle it is explained in our Privacy Policy. You can delete your account at any time from inside the app, which permanently removes your account and everything you added. We recommend keeping your own copy of anything important.

6. Subscription, Billing, and Free Trials

• Every account starts with a free trial. After the trial, some features need a paid subscription.
• Subscriptions renew automatically until cancelled and are billed by the App Store or Google Play at the price shown in the app.
• To avoid being charged for the next period, cancel at least 24 hours before the current period ends in your App Store or Google Play subscription settings.
• Refunds are handled by Apple or Google under their policies.
• Deleting your account does not cancel your subscription.
• Without an active subscription Thingys is read-only: you can still see your information and delete your account, but not add or change things.

7. Acceptable Use

You must not use Thingys:

• To break the law, or to harm or harass others.
• To store content you have no right to store.
• To try to access other people’s accounts or data.
• To probe or disrupt our systems.
• To copy, resell or reverse engineer the app, except where the law allows it.

We may limit or end accounts that do.

8. Intellectual Property

The Thingys app, name, logo and design belong to Anouk Solutions (Pty) Ltd. We give you a personal, non-exclusive, non-transferable licence to use the app for your own purposes while these Terms are met. Apple’s and Google’s own app store terms also apply to how you get and use the app.

9. Availability and Changes to the Service

We work to keep Thingys running, but we do not promise it will always be available or error-free. We may add, change or remove features at any time.

10. Suspension and Termination

You can stop using Thingys and delete your account whenever you like. We may suspend or close an account that breaks these Terms or puts the service or other users at risk, and we may stop offering Thingys altogether, giving reasonable notice where we can.

11. Disclaimers and Limitation of Liability

Thingys is provided “as is”. To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, income or profit arising from your use of Thingys. Nothing in these Terms limits any right you have under law that cannot be excluded, including under the South African Consumer Protection Act where it applies.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of South Africa, and the South African courts have jurisdiction, without affecting any rights you have under the mandatory consumer laws of the country where you live.

13. Changes to These Terms

We may update these Terms from time to time. If we make a material change we will update the date above and, where we can, tell you in the app. Using Thingys after a change means you accept it.
